Serbia Tax Residency: 183 Days, Center of Interests and Certificate
Serbia tax residency decides whether you report only Serbian-source income or your worldwide income. The answer sits in Article 7 of the Personal Income Tax Law: you are a resident if you have a domicile or a center of business and life interests in Serbia, or if you spend 183 or more days in Serbia within a 12-month period that begins or ends in the tax year. Below we explain what each test means in practice, the consequences, how dual residency is resolved and how to obtain a certificate of residency.
Who is a Serbian tax resident
Domicile
Domicile is the place where you have settled with the intention to live permanently. For Serbian citizens it is usually the address on the ID card.
Center of business and life interests
This test looks at where your family lives, where your children go to school, where you keep a home in permanent use, and where your job, company, bank accounts and social insurance are. You can spend fewer than 183 days in Serbia and still be a resident if your spouse, children and main income source are here.
183 days in 12 months
Days of physical presence count, continuous or with breaks. The 12-month window does not have to match the calendar year. It only needs to begin or end in the tax year in question.
For non-residents the rule is simple: they pay Serbian tax only on income sourced in Serbia, for example salary from a Serbian employer, rent from Serbian property or dividends from a Serbian company.
What residency changes in practice
| Question | Serbian resident | Non-resident |
|---|---|---|
| What is taxed | worldwide income | only Serbian-source income |
| Income from a foreign payer | PP OPO return within 30 days | no Serbian obligation |
| Foreign dividends and interest | 15% with credit for foreign tax | no Serbian obligation |
| Annual income tax | yes, above 5,439,096 RSD for 2025 | only on Serbian income |
| Treaty application | as Serbian resident, with POR-1 | as resident of the other state, with POR-2 |
The most important consequence is self-assessment. A resident who receives salary, fees, dividends or interest from a foreign payer files the PP OPO return within 30 days of receipt. We covered the procedure in foreign income in Serbia and the PP OPO return. The second consequence is the annual personal income tax, which residents pay on total income above three average annual salaries.
Dual residency and tie-breaker rules
It happens that both Serbia and another country treat you as their resident, because each applies its own domestic rule. Then the double taxation treaty decides. Serbia has 64 treaties in force, covering almost all of Europe, Russia, China and Canada, but there is no treaty with the United States. The list is kept by the Ministry of Finance.
Treaties generally follow the OECD model and apply the tests in order. You move to the next test only if the previous one gives no answer:
- Permanent home. Where you have a home permanently available to you. A one-year rental counts, a hotel does not.
- Center of vital interests. Where your personal and economic ties are closer: family, work, property, social life.
- Habitual abode. Where you spend more time if the first two tests do not separate the countries.
- Nationality. If habitual abode does not help either.
- Mutual agreement of the two tax authorities as the last step.
The outcome matters because it decides which country taxes worldwide income and which taxes only its own source income.
How to get a certificate of residency
The certificate is issued by the Serbian Tax Administration, at the branch for your domicile or residence. There are two forms. POR-1 certifies that you are a Serbian resident and is used with a foreign payer so it can apply treaty rates or an exemption. POR-2 is the form a resident of another state uses to prove status to a Serbian payer, and a certificate from a foreign tax authority is accepted if it contains the same data.
A Serbian citizen attaches a certificate of domicile from the police, not older than six months, and proof of the administrative fee. A foreign individual seeking confirmation of Serbian residency attaches a certified passport copy, a temporary residence permit longer than six months or permanent residence, proof of address registration, an employment contract with a Serbian employer or proof of ownership of a home. The Tax Administration may ask for further evidence of the center of interests. The certificate is issued for the current or previous year and in practice takes a few weeks, so apply before the foreign payer asks for it.
Typical situations
Relocation from Russia
A person who moved to Belgrade with family, opened a company and registered temporary residence becomes a Serbian resident on the center of interests test, often before 183 days pass. The 1995 treaty between Serbia and Russia applies, so dual residency is resolved through the tie-breakers. Russian-source income such as dividends or rent is reported in Serbia via PP OPO with a credit for Russian tax up to the Serbian amount. Owners who use their company as a residence basis can read our guide on residence in Serbia through a company.
Remote work for a foreign employer
If you live in Serbia and work for a company in Germany or the United States, the salary is taxed in Serbia as resident income, through PP OPO or the quarterly freelancer model. An employer in a treaty country can stop withholding only after receiving your POR-1.
Investor with a foreign broker
A Serbian resident reports dividends and capital gains from foreign accounts. Withholding tax retained abroad is credited up to 15% with proof from the foreign tax authority. Non-residents have no Serbian obligation for such income. See our post on foreign broker tax in Serbia.
What a resident files during the year
- PP OPO for each payment from a foreign payer, within 30 days of receipt.
- PP OPO-K quarterly, if you chose the freelancer model for contracted fees.
- PPDG-2R annual return by May 15, if total income for the previous year is above the threshold.
- A POR-1 request whenever a foreign payer asks for proof of residency.
Common mistakes
- Counting 183 days only within the calendar year and ignoring the 12-month window that spills into the next year.
- Believing you are a non-resident because you lack Serbian citizenship while your family and job are in Serbia.
- Reporting foreign income only in the annual return instead of through PP OPO within 30 days.
- Assuming a treaty exists with every country. There is none with the US, so double taxation is softened only by the domestic tax credit.
Frequently asked questions
Does a foreigner with a temporary residence permit automatically become a tax resident?
Not automatically. A residence permit is an immigration status, tax residency is a tax status. A foreigner becomes a resident when one of the three Article 7 tests is met, usually the 183-day or center of interests test.
From which day does residency start?
The law does not split the year into resident and non-resident parts, so in practice status is assessed for the tax year as a whole, with treaties resolving conflicts when another country claims the same. Document your arrival and departure dates.
How long is a certificate of residency valid?
It is issued for a specific year and states the period it covers. Foreign payers generally ask for a new certificate every year.
