Appealing a Tax Decision in Serbia: Procedure, Deadlines and When It Makes Sense
You received a tax decision you disagree with: tax you consider wrong, a refused refund, or a payment order after an inspection. The decision is not the final word. Tax procedure provides for an appeal, and after it an administrative court dispute. But both remedies have short deadlines and require arguments, not just disagreement.
First: read the decision calmly and fully
Every decision contains reasoning and instructions on the legal remedy, stating to whom the appeal is filed and within what period from receipt. That period is short and runs from delivery, so the first step is always the same: note the date of receipt and immediately check the deadline. Second: do not pay or sign anything in panic, but do not ignore the decision either, because an appeal does not automatically stop all consequences.
What an appeal should contain
- Concrete objections. What is wrong in the decision: facts, calculation, application of the rules, or procedure. General dissatisfaction is not a ground.
- Evidence. Contracts, statements, records and calculations supporting each objection.
- Proper form and deadline. An appeal filed late or incomplete can be rejected before anyone reads its merits.
What comes after the appeal
The second-instance authority decides on the appeal: it can uphold, amend, or annul the decision and return the case for a new procedure. If the second-instance decision is also unfavorable, an administrative court dispute remains, with its own deadline from receipt of that decision. Each stage has its tactics, and a realistic assessment of chances should be heard before entering the dispute, not after.
Is the fight worth it
Honest answer: it depends on the amount and the quality of arguments. Some decisions are successfully overturned because facts were wrongly established or procedure was not followed.
